Automobile Accidents, Tort Law, Externalities, and Insurance: An Economist’s Critique

چکیده
Preface – By Todd Litman This is a seminal article concerning traffic accident cost analysis and vehicle insurance pricing reform by Professor William Vickrey, winner of the 1996 Nobel Prize for economics. It describes how to determine the marginal accident costs of vehicle travel, identifies several problems associated with current insurance pricing and compensation practices, and proposes innovative solutions. It recommends distance-based pricing, that is, basing premiums directly on annual vehicle mileage. In recent years there has been increasing interest in this idea, including pilot projects and legislation intended to promote implementation of distance-based insurance pricing.

The Effect of No-fault on Fatal Accident Rates
Thirteen states currently either mandate no-fault auto insurance or allow drivers to choose between no-fault and tort insurance. No-fault auto insurance requires individuals to carry personal injury protection (PIP) insurance that compensates them for economic losses sustained in automobile accidents, regardless of whoever is at fault, and prohibits individuals from suing for non-economic damag...
متن کاملAutomobile Externalities and Policies
This paper reviews theoretical and empirical literature on the measurement of the major automobile externalities, namely local pollution, global pollution, oil dependence, traffic congestion and traffic accidents. It then dicusses the rationale for traditional policies to address these externalities, including fuel taxes, fuel economy standards, emissions standards and related policies. Finally...
متن کاملTort Reform and Accidental Deaths
Theory suggests that tort reform could have either of two impacts on accidents. First, reforms could increase accidents as tortfeasors internalize less of the costs of externalities, and thus, have less incentive to reduce the risk of accidents. Second, tort reforms could decrease accidents as lower expected liability costs result in lower prices, enabling consumers to buy more risk-reducing pr...

In his landmark 1961 article, Some Thoughts on Risk Distribution and the Law of Torts, Judge Calabresi provides a theoretical framework for analyzing tort liability as a risk-spreading device that functions in a manner similar to insurance. In our article, we examine the insurance objective of tort liability from the standpoint of modern tort law. Since Calabresi’s foundational article, there h...

Light or heavy trucks and sport-utility vehicles (SUVs) are increasingly popular, in part because they provide improved protection to their own passengers in an accident. However, when an accident occurs, these vehicles also cause greater injury to passengers of other vehicles, pedestrians, bicyclists, and motorcyclists. Because the costs of these injuries are external costs in no-fault auto-li...
